The crash that killed Iowa State Patrol Trooper Ted Benda last month happened when he swerved to avoid a deer while responding to a call at high speed, Iowa State Patrol reported Friday.

Robert James Smith will be formally charged next week in U.S. District Court with one count of deprivation of rights under color of law. He is accused of willfully depriving “Victim 1” on Sept. 25, 2017, of the right to be free from unreasonable seizures and unreasonable force by a law enforcement officer, the indictment states.

At about 6:10 p.m., a driver was traveling north on Highway 1, between Iowa City and Solon at Fox Lane NE, when a deer ran into the path of the car, according to the Iowa State Patrol.

Hundreds of Iowa State Patrol troopers gathered in Waukon for the funeral of Trooper Ted Benda, who died Oct. 20 after crashing his patrol car while going to assist with a call in Clayton County. The service at the Waukon High School was expected to be attended by family, friends, community members and law enforcement.

The funeral begins at 11 a.m. at Waukon High School and is being livestreamed.

Steven Kohli, 69, was checking the damage to a vehicle he was in that had just struck a deer on Interstate 35 in southwest Warren County.

Scores of people paid their respects to Trooper Ted Benda, who was killed in a Northeast Iowa crash earlier this month while responding to an emergency call, as his body was escorted Friday to a Waukon funeral home.
