CEDAR RAPIDS - A Cedar Rapids man faces federal charges for possessing firearms while using marijuana.
According to the U.S. Northern District of Iowa Attorney's Office, 24-year-old Kendan Fonville has been charged with two counts of being an unlawful drug user in possession of firearms. Fonville faces up to 20 years in prison and a $500,000 fine.
Fonville is accused of having a stolen AK-47 rifle while being a marijuana user on March 24, 2012 and possessing a .38 caliber handgun on Aug. 31, 2012 while he was a marijuana user.
According to the U.S. Attorney's Office, Fonville, aka Fudd, has four prior arrests for possession of marijuana and one prior arrest for possession of crack cocaine. He was arrested on March 24, 2012 after Cedar Rapids police officers heard shots fired in the 1400 block of Fourth Avenue SE. The responding officers recovered a stolen AK-47 and 22 spent rifle casings. Witnesses told officers they saw Fonville firing the rifle, police said.
During the Aug. 31, 2012 incident, Cedar Rapids police attempted a vehicle stop and Fonville ran from the driver's side of the vehicle. Police said as the foot chase ensued, Fonville was seen reaching into the waist band of his pants. Police lost track of him during the chase and suspect during that time he was getting rid of a firearm.
After retracing their steps, police said they found the .38 caliber pistol.
Fonville is scheduled to be arraigned on Nov. 4.
