Trial for Marion man accused of sex abuse is reset for 10th time

The trial for a Marion man accused of sexual abuse and sexual exploitation of a child didn't begin Monday as scheduled because the alleged victim told a prosecutor last week that she doesn't remember what happened.
According to court motion filed last week, the girl was shown interviews she had with a forensic interviewer at the Child Protection Center in 2011 in which she made "disclosures" about the abuse between the ages of 3 and 5, but the girl said she had no memory of the incidents of abuse.
James Olds, 45, is charged with second-degree sexual abuse, sexual exploitation of a minor, lascivious acts with a child, lascivious conduct with a minor, indecent contact with a child and indecent exposure and false imprisonment. He is accused of sexually abusing and repeatedly exploiting a girl between the time she was 3-1/2 to 6 years of age, according to a criminal complaint and search warrant.
First Assistant Linn County Attorney Nick Maybanks in the motion said after questioning the girl he believes she doesn't remember. He is asking the court to allow the state to submit the videotaped interviews into evidence at trial.
A judge set a hearing Dec. 12, regarding Maybanks' motion and also on change of venue, which the defense also filed based on pre-trial publicity last week and the trial is reset to March 3, for the tenth time since 2011.Olds is also charged in another separate sexual abuse case involving an adult. He is charged with third-degree sexual abuse and accused of sexually assaulting a woman Aug. 2009 at his residence, according to a criminal complaint. That trial is set Dec. 16.
