Rubashkin appeals detention to U.S. Court of Appeals
Trish Mehaffey Dec. 8, 2009 1:00 pm
Attorneys for former Agriprocessors vice president Sholom Rubashkin will appeal his motion for bail to the U.S. Court of Appeals.
The attorneys filed a notice with the U.S. District Court Monday.
Chief Judge Linda Reade denied Rubashkin two motions for bail last month pending his sentencing on 86 counts of bank fraud and other charges, which hasn't been set. Reade ruled Rubashkin was a flight risk.
Rubashkin, 50, of Postville, was convicted by jury last month on bank , mail and wire fraud, money laundering and non-payment of livestock charges stemming from the May 2008 federal immigration raid at the Postville kosher meatpacking plant.
