Review found Clayton County deputy followed proper procedures in Luana shooting

A reserve Clayton County deputy followed proper procedures in an Oct. 25 duty-related shooting in Luana, an independent review of the incident has found.
Deputy Mary Bissell acted in accordance with the Sheriff's Office's policies and procedures during the incident, which led to the filing of several charges against Waylin Buerger, 35, of Luana, according to the investigation conducted by the Prairie du Chien, Wis., Police Department.
Buerger allegedly ran several stop signs during a police chase from Monona to Luana that at times exceeded 90 mph, according to complaints filed in Clayton County District Court.
When Buerger finally stopped, he exited his car and “started to ram (Bissell) with his shoulder multiple times,” the complaint said.
The attack continued after Bissell drew her weapon, which she then fired, causing Buerger to drop to the ground, where Bissell held him until help arrived, according to the complaint.
Both Buerger and Bissell were taken to Central Community Hospital in Elkader, where they were treated for minor injuries and released, according to the Sheriff's Office.
Buerger has been charged with eluding police and assaulting a police officer, both class D felonies; second-offense drunken driving, an aggravated misdemeanor; and speeding, disobeying a stop sign and driving on the wrong side of a highway.
Buerger has pleaded not guilty to all charges and is awaiting a March 24 jury trial.
