Iowa City man arrested in December sexual abuse

Police arrested an Iowa City man for third-degree sexual abuse Monday.

Adrian Marcos, 22, is accused of having sexual intercourse with a woman while she was asleep on Monday, Dec. 14, 2009 at the 800 block of Oakcrest Street, Iowa City.

According to police documents, Marcos met the woman at her apartment where the pair both drank alcohol. Police said the woman made it clear she didn't want to have sexual relations with Marcos by telling him “no.”

Officers said both the woman and Marcos fell asleep in the living room. Later the woman awoke to Marcos having sex with her.

Police said Marcos later told police that he remembers waking up and seeing the woman asleep, then he touched her breasts and butt and later had intercourse with her while she was sleeping.

In the police report, Marcos said, “he knew it was wrong and he is sorry for what he did.”

Third-degree sexual abuse if a Class C Felony, punishable by a maximum prison term of 10 years and a fine of  at least $1,000 but no more than $10,000.

Marcos is currently at the Johnson County Court Jail being held on a $10,000 bond.
