The sexual assault trial of former University of Iowa football player Cedric Everson has been continued in Johnson County District Court, according to court documents released Wednesday.
Everson's attorney Leon F. Spies said because of his own personal health concerns, which he shared with Assistant County Attorney Anne Lahey and Chief Judge Patrick Grady, Spies feels he will not be able to effectively represent Everson at the trial set for July 12.
Everson did not appear in court Wednesday. A motion to waive his appearance was filed Monday.
Spies also requested a status conference about two to three weeks from July 5 to set a new pretrial hearing and trial date.
Although he did not disclose the specifics of his health concerns, Spies said he may do so at a later date.
“To much is up in the air right now,” he said.
Everson, 21, is charged with second-degree sexual assault for his alleged involvement in the rape of a female former UI student athlete in October 2007.
Former teammate Abe Satterfield, 21, entered a written guilty plea April 9 to assault with intent to inflict serious injury, an aggravated misdemeanor, and is scheduled for sentencing July 23.
