A Chicago man who tried to get rid of his heroin in a toilet at the Cedar Rapids Police Department pleaded guilty Thursday in federal court.
Julius Montgomery, Jr., 48, of Chicago, Ill., pleaded guilty of possession with intent to distribute heroin. In a plea agreement, Montgomery admitted the Drug Enforcement Agency conducted a controlled buy of heroin from a car in which he was a passenger on Nov. 10, 2015. The car was then stopped and searched for drugs.
The plea agreement shows an officer at the scene noticed Montgomery, as he stood up was 'tightly clenching his buttocks,” but he denied that he concealing anything.
During questioning at the police department, Montgomery asked to use the bathroom but investigators took him to a bathroom that was equipped with a toilet designed for prisoners, according to the plea. The toilet cannot be flushed by the prisoner and can only be flushed from an exterior location. The toilet was searched before Montgomery used it and it was empty. After Montgomery left the bathroom, investigators found a bag in the toilet water, which contained 23 individual packages of heroin, totaling 2.1 grams.
Montgomery also admitted in the plea agreement to selling heroin to confidential informants twice in 2014.
Montgomery remains in jail pending sentencing, which hasn't been set. He faces up to 20 years in federal prison and a $1 million fine.
