Cedar Rapids man convicted of sexually abusing 13-year-old girl

CEDAR RAPIDS — A 44-year-old man pleaded guilty Thursday to sexually abusing a 13-year-old girl over the course a month in 2013.
Troy Davenport, of Cedar Rapids, pleaded guilty to lascivious acts with a child in Linn County District Court. He admitted during the plea hearing to fondling or touching the girl Sept. 1 through Oct. 31, 2013.
Sixth Judicial District Senior Judge Thomas Koehler told Davenport he faces 10 years in prison, but according to the plea agreement, the state will recommend a suspended sentence and probation.
First Assistant Linn County Attorney Nick Maybanks said Davenport has already served two years in jail pending trial, and based on his mental health issues, this plea was the best outcome for this case.
Maybanks added that Davenport will be on the sex offender registry for life and have the special sentence of lifetime parole following his probation time. If Davenport reoffends, he would be subject to predator enhancement which would increase his prison term.
Koehler also allowed Davenport to remain on pretrial release so he can participate in an intensive mental health re-entry program, which was part of the plea agreement.
Another judge in 2014 sent Davenport for a mental evaluation at the Iowa Medical Classification Center in Coralville and he was found incompetent to stand trial. Two psychologists said he had a mental disorder which affected his ability to understand the proceedings and effectively assist in his case.
Court proceedings were suspended until last May, when his competency was restored.
The other pending charge of third-degree sexual abuse will be dismissed at sentencing, as part of the plea agreement. Sentencing will be set later.
