Public Measure 1 — Strict scrutiny.
We are dealing with a universal, God-given right in the Second Amendment and the new proposal. Either one is able to preserve and protect their own life and safety with whatever means are readily available or they aren’t. The U.S. Constitution recognizes it, as has SCOTUS now twice, so there is absolutely no reason for Iowans not to adopt the same in our charter.
As per the strict scrutiny clause, it is merely a protection that such a right, and one’s opportunity for protection against aggressors, either criminal or state-sponsored, will not be negotiated away in favor of such aggressors. Iowans expect judges and courts to be able to read plain English. As demonstrated over much of the 20th Century, they were either unable to comprehend The Founders, or intentionally watered down this, and many other rights in favor of the state, not for the people. This is in direct conflict with the spirit and intent of our founding documents.
As far as only a few states requiring strict scrutiny — we should be thankful that Iowa is at the forefront of what will inevitably become a wave of states’ rights issues in the future. It is important that courts and judges respect the will of the people, not vice versa. The amendment, along with the strict scrutiny law must stand.
Protect your rights and the rights of future generations, vote yes on Public Measure 1.
