Marriage is an institution and a right

To the editor:
Justice Antonin Scalia's dissent in Obergefell v. Hodges charges the majority with the offense of judicial activism - legislating from the bench. So it is. And, so was Brown v. Board of Education and Roe v. Wade, and Bush v. Gore, in which Scalia eagerly turned the Constitution upside down and legislated for all he was worth.
What must bother Scalia is the object of this judicial meddling. He believes marriage to be the sacred linking of one man and one woman. Marriage, like education, is an institution and as such we do not serve it, it serves us. Marriage is a fundamental right and as such it may be enjoyed by people without regard to race, creed or sex. But Scalia may comfort himself with the reflection that many gay couples will be as miserable in marriage as heterosexuals sometimes are.
