Are auditor role switches legal?

Joel Miller was re-elected to Linn County auditor in November with specific things to run. That is what we voted for. Now it is all being given to the man that lost the election for that office, Garth Fagerbakke. If there was going to be a change in duties of the office, it should have been made before the election for that term, not made up as time goes along.
The facilities management job was taken from Miller and returned to Fagerbakke and this comes with a big salary. This poses a question. Is this all lawful? This inner-fighting just keeps getting worse. Makes for lots of lost confidence in the government.
