Sep. 24, 2014 6:24 pm
CEDAR RAPIDS - A 44-year-old Cedar Rapids man charged with sexually assaulting a 13-year-old girl last year has been found incompetent to stand trial.
Sixth Judicial District Judge Mary Chicchelly said two psychiatrists who evaluated Troy Davenport at the Iowa Medical and Classification Center said he was suffering from a mental disorder and found him not competent for trial. She said based on those evaluations, further court proceedings will be suspended until he is found competent.
First Assistant Linn County Attorney Nick Maybanks had no objections. He did ask for a separate hearing regarding bond. Davenport had previously been out of custody on bond. The bond review will be Sept. 30 in Linn County District Court.
Davenport is charged with third-degree sexual abuse and lascivious acts with a child. He is accused of fondling and sexually assaulting the 13-year-old Sept. 1 through Oct. 31, 2013, according to a criminal complaint.
