Iowa panel takes first step to change topsoil construction rule

DES MOINES - State environmental regulators agreed Wednesday to change a state rule requiring that builders and construction companies return four inches of topsoil to construction sites upon completion of a new home or development.
By voice vote, members of the Iowa Environmental Commission began the rule-making process of adopting a regulation more closely aligned with the federal standard that would require the preservation of topsoil where feasible without measurable levels.
The change came after most members of an advisory panel that represented primarily homebuilders, developers and earth-moving companies recommended that the EPC do away with a requirement that a uniform post-construction four-inch layer be restored at work sites. The commission now will hold three public hearings before taking final action on the proposed rule change.
Creighton Cox of the Homebuilders Association of Greater Des Moines, who served as chairman of the stakeholders group, said the four-inch topsoil retention standard the state adopted two years ago at the request of developers adds costs to homeowners.
Chris Classon, a developer who also served on the seven-member advisory panel, said cities are providing proper oversight of the topsoil retention issue and he supported 'the new rule as the governor has written it.”
However, Virginia Soelberg of Johnston called the proposed rule 'flawed” and Pat Sauer questioned why a change was needed.
