Jury selection will resume Tuesday in Linn County District Court for the murder trial of Justin Ross, who is accused of fatally shooting Andre Herron in November 2011.
Testimony will likely begin in the afternoon. The trial is expected to last more than a week.
Ross, 19, of Cedar Rapids, is charged with first-degree murder. He is accused of intentionally shooting Herron, 30, and causing his death, according to a criminal complaint. Herron was found dead on 7
th
Street SW on Nov. 26, 2011.
According to the criminal complaint, Justin Ross intentionally and with premeditation shot and killed Herron with a .45 caliber revolver. No other details of a possible motive for the shooting have been released.
Herron moved to Cedar Rapids from Chicago about five years before the shooting, Herron's father Albert Allen, of Chicago, told The Gazette in November 2011. At that time, nobody had been arrested and charged in the case and Allen and other family members said they wanted justice for Herron's death.
Justin Ross' cousin, Donovan Ross, 21, of Hiawatha, is also charged with first-degree murder in this case. He is accused of aiding and abetting or causing the death of Herron, according to the criminal complaint. He shot Herron with a .22 caliber revolver.
Multiple witnesses placed Justin and Donovan Ross at the scene when Herron was shot, according to search warrant affidavit. Alison Cunningham, 18, was with the Ross cousins when the shooting happened. Cunningham told police she was with Donovan and Justin who were outside of a car with Herron when the shooting occurred. She will testify during the trial.
According to court filings, Donovan Ross was previously set to accept a plea agreement twice in the last few months but cancelled the last hearing and now his trial is set Oct. 7.
