CEDAR RAPIDS — A Cedar Rapids man was arrested Tuesday on charges that he fired a gun at two men who were in a car in an alleyway next to his house in the 500 block of Sixth Ave. SW.
Brodie Breyer, 24, is charged with intimidation with a dangerous weapon, going armed with intent, and use of a dangerous weapon in the commission of a crime.
According to a criminal complaint, Breyer came out of his house with a gun on Sept. 15 and approached a vehicle in the alleyway between Sixth Avenue SW and Seventh Avenue SW. He pointed his gun at the passenger in the vehicle, Jashaun Taylor. The driver, Shawn Albert, began driving away, and Breyer shot at the vehicle.
Cedar Rapids Police officers who were in the area drove toward the scene when they heard what sounded like five or six gunshots. They saw the car speeding out of the alleyway and pulled the car over. Taylor and Albert spoke with the officers about what had happened, and the officers noticed damage on the passenger side of the door that appeared to be from gunfire, according to a search warrant request filed in September.
The officers then checked the alleyway and found multiple live rounds of ammunition outside Breyer’s house. While they were searching the alleyway, Breyer yelled “stand your ground” at them out his window. They got in contact with Breyer over the phone, and he told them they should be investigating a trespassing, and refused to come outside or say anything else about the shots fired, according to the warrant request.
A judge granted the warrant request in September, and police searched Breyer’s home and found a 9 mm firearm, which was a potential match to the shell casings found outside the home.
An order for Breyer’s arrest was issued on Oct. 29, and he was booked into the Linn County Jail on Tuesday. He had his first appearance in court Wednesday and is being held on a $17,000, cash-only bond.
