Marion man charged with election misconduct
He is accused of giving the wrong address when he voted in 2024

A Marion man was arrested Thursday on a charge of first-degree election misconduct, after police say he wrote down a Cedar Rapids address that he hadn’t lived at for six years when voting in the 2024 elections.
Cody Swain, 35, voted on Oct. 30, 2024, at Lindale Mall in Cedar Rapids. He listed 2050 Glass Rd. Apt. 204 as his address on his registration form, despite having moved out of that apartment in 2018, according to a criminal complaint.
Swain had lived at the address in Marion for three years, the complaint states.
The election misconduct charge was initially filed against Swain in April, and a warrant was issued for his arrest when he didn’t appear in court for an initial appearance.
First-degree election misconduct is a class D felony, punishable by up to five years in prison and a fine ranging from $1,025 to $10,245.
He is currently being held in the Linn County Jail on a $4,000 bond.
