Richard Olmstead Jr., 42, of Cedar Rapids, was found not guilty of second-degree sexual abuse Wednesday in a non jury trial by a judge in Linn County District Court.
Olmstead was accused of abusing a 5-year-old boy in three separate incidents in 2001 and 2002.
Sixth Judicial District Judge Robert Sosalla said the child had difficulty remembering times and dates of the incidents, which is not unusual for a someone his age, but the testimony and other evidence fell short in proving Olmstead committed the sexual acts.
Sosalla said the boy may have been abused by someone in his past but the evidence failed to show it was Olmstead.
