No charges will be filed in 2008 Dyersville shooting death

A Dubuque County grand jury has found Christopher Leppert legally justified in the November 2008 shooting death of a Dyersville man.
Dubuque County Attorney said no charges will be filed against Leppert, a Dubuque locksmith who was identified by authorities as the shooter of David Herman, 24, outside of a Dyersville apartment complex on Nov. 29, 2008.
The seven-member grand jury, charged with determining whether an indictment of criminal charges would be filed, heard testimony for the past three days.
Leppert was at the apartment complex to change locks on two apartments, according to authorities. he and Herman exchanged blows during a fight after Herman and his girlfriend, Jen Fauver, returned to move belongings after being evicted, witnesses told investigators.
The fight spilled over to Leppert's car, where his gun was hidden. Herman jumped into the car, and witnesses told authorities that Leppert fired at least two shots, one striking Herman's chest.
