A Get-Out-of-Court Free Card?

Aug. 12, 2010 10:25 am
One thing I missed in yesterday's unveiling of "Iowa for Freedom," Bob Vander Plaats' new Iowa Supreme Court justice removal service, was BVP's new strategy for getting around that pesky separation of powers/checks-and-balances stuff.
He still believes a governor can nullify a SUPCO ruling with an executive order. But, wait, there's more:
He is also now advocating for the legislature to re-affirm a new version of the Defense of Marriage Act including a provision in this new legislation limiting the jurisdiction of the courts to review the law or strike it down. This is something that Vander Plaats didn't talk about on the campaign trail, but it is a position that Jan Mickelson, the morning radio show host on WHO Radio, has advocated for.
So now we can pass laws with language barring the courts from reviewing their constitutionality. A get-out-of-court free card, for lawmakers on the go, who simply can't be bothered by that wordy state Constitution. Proposed by a radio host. This just gets better and better.
Oh, and Iowa RNC member Kim Lehman is talking 'bout a revolution. We'd all love to see the plan.
On the other side, a bipartisan group,
Iowans for Fair & Impartial Courts, has been formed to counter Iowa for Freedom. It's co-chaired by former Iowa Democratic Party chair Scott Brennan and former Iowa RNC member Steve Roberts. Former Branstad chief of staff Bob Rafferty is also on board. His former boss, unfortunately, is on the sidelines.
