Judge gives C.R. man deferred judgment for sexually abusing 14-year-old girl

A 44-year-old man received a deferred judgment and five years probation for sexually abusing a 13-year-old girl over the course of a month in 2013.
Troy Davenport, of Cedar Rapids, pleaded guilty to lascivious acts with a child in October. He admitted during the plea hearing to fondling or touching the girl Sept. 1 through Oct. 31, 2013.
Sixth Judicial District Chief Judge Patrick Grady granted Davenport a deferred judgment, instead 10 years in prison, and five years probation. He will also have to serve a special sentence of lifetime parole because this is a sex offense. Grady also placed a no-contact order between Davenport and the the 13-year-old.
First Assistant Linn County Attorney Nick Maybanks recommended a 10-year suspended sentence and probation. The deferred, requested by the defense, will allow Davenport's record expunged if he successfully completes the five years probation. If Davenport reoffends, he would be subject to predator enhancement which would increase his prison term.
Maybanks said he made the recommendation because Davenport has spent nearly two years in jail pending trial and the plea prevented more trauma for the child, who would have had to testify at a trial and face Davenport. This was also the best outcome, considering that Davenport has mental issues.
Grady dismissed the remaining charge of third-degree sexual abuse, also part of the plea agreement.
Another judge in 2014 sent Davenport for a mental evaluation at the Iowa Medical Classification Center in Coralville and he was found incompetent to stand trial. Two psychologists said he had a mental disorder which affected his ability to understand the proceedings and effectively assist in his case.
Court proceedings were suspended until May 2014, when his competency was restored.
