Jury questionnaires may determine moving Marengo murder trial
Trish Mehaffey Dec. 15, 2009 5:05 pm
Prospective jurors must return questionnaires today to the clerk of court's office to determine if a fair and impartial jury can be seated next month in the first-degree murder trial of Jessica Dayton.
Dayton, 19, of Belle Plaine, is accused of killing Curtis Bailey, 33, of Marengo, in July. Her trial is set for Jan. 4 in Iowa County District Court.
Bailey's common-law wife, Denise Frei, 42, of Marengo, and her son, Jacob Hilgendorf, 19, of Belle Plaine, are also charged with first-degree murder. Their trial is set for May 17.
Dayton's attorney said jury questionnaires would prove a change of venue is needed based on prejudice from pretrial publicity.
The prosecution does not want the trial moved.
