Judge rules man accused of sexually assaulting 13-year-old girl is competent for trial

CEDAR RAPIDS - A judge reinstated court proceedings Tuesday against a man accused of sexually assaulting a 13-year-old girl after a psychiatrist and psychologist found him competent to stand trial.
Sixth Judicial District Judge Chad Kepros said Troy Davenport, 44, of Cedar Rapids, received treatment and his competency was restored based on a report from a psychiatrist at the Iowa Medical Classification Center. Kepros reset the trial for Nov. 2 in Linn County District Court.
Court proceedings have been suspended since September 2014 when Davenport was found incompetent. Two psychologists at that time said he had a mental disorder which affected his ability to understand the proceedings and effectively assist in his case. Davenport was then sent to IMCC for treatment to restore his competency.
Davenport's attorney, Sarah Hradek, has concerns about the IMCC report finding him competent in May and asked a judge for more time to talk to the psychiatrist and possibly get another opinion. Hradek said Tuesday an independent evaluation also found that his competency was restored.
Davenport is charged with third-degree sexual abuse and lascivious acts with a child. According to the criminal complaint, he is accused of fondling and sexually assaulting a 13-year-old girl Sept. 1 through Oct. 31, 2013.
