Marion man accused of sexually abusing incapacitated woman

MARION — A Marion man was arrested Monday on charges of third-degree sexual abuse, felon in possession of a firearm and possession of a controlled substance.
John Wayne Brooks, 60, is accused of sexually assaulting a woman Jan. 22 while she was “mentally and/or physically incapacitated and/or physically helpless,” according to a criminal complaint.
As part of the sexual assault investigation, Marion police conducted a search at Brooks’ Marion residence, where the alleged assault took place.

While conducting the search, police found marijuana and a 9 mm gun, the complaint states. Brooks is prohibited from owning a gun because of a 1999 felony conviction in Illinois for manufacturing and delivering a controlled substance.
Brooks had his first court appearance Tuesday and is being held on a $16,000 cash or surety bond. A no-contact order has been filed on behalf of the woman.
