Iowa City man arrested after allegedly drinking from open bottles behind bar counter

CEDAR RAPIDS - An Iowa City man was arrested at 1:27 a.m. Sunday morning after Iowa City Police say he walked behind the bar at an establishment in the pedestrian mall and then began to drink liquor from open bottles that were being stored there.
Reports indicate that Nicholas R. Apple, 25, of 436 Samoa Drive, was charged with fourth degree theft and public intoxication after he allegedly went behind the counter at the Union Bar, located at 123 E. College Street.
Iowa City Police say employees informed them that Apple had been drinking out of three different bottles of alcohol that had been opened and were worth approximately $250.
Upon contact with Apple in the pedestrian mall, Iowa City Police officers noted that he had a strong odor of alcohol, bloodshot eyes and slurred speech. Apple refused to give consent for a preliminary breath test.
Apple was being held at the Johnson County Jail waiting to appear before a judge on Sunday morning. He faces charges of fourth degree theft and public intoxication.
